Terms of Use.

1. Acceptance of these Terms

By creating a Showcify account or using any part of the Showcify service (the “Service”), you agree to these Terms of Use (“Terms”) and to our Privacy Policy. If you don't agree with any part of these Terms, please don't use the Service.

Showcify (“Showcify”, “we”, “us”) is operated by Showcify Inc., based in India.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account. By signing up, you confirm that you meet this requirement and that the information you provide is accurate, current, and complete.

You're responsible for safeguarding your password and for all activity under your account. Notify us immediately at support@showcify.com if you suspect unauthorized access.

3. Your content

3.1 You own it

Anything you upload, create, or publish through the Service — your resume, portfolio, case studies, images, links, written content (“Your Content”) — remains yours. We don't claim ownership of Your Content.

3.2 What you grant us

To run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, copy, transmit, and (where you choose to publish a portfolio) publicly display Your Content. This licence exists only so we can deliver the Service to you and your audience. It ends when you delete the content or close your account, except as described in § 3.4.

3.3 Your representations

You represent and warrant that:

• You own Your Content or have the necessary rights to upload and share it.
• Your Content does not infringe any third party's intellectual property, privacy, or other rights.
• Your Content is accurate and not misleading (especially around employment history, education, and qualifications).
• Your Content does not contain malware, hateful content, harassment, or anything illegal.

3.4 Backups

We keep encrypted backups for up to 30 days for disaster recovery. Your Content may exist in those backups for that period after you delete it from your account.

4. Acceptable use

You agree not to use the Service to:

• Misrepresent your identity, work history, qualifications, or credentials.
• Upload someone else's resume or portfolio content as your own.
• Send spam, phishing attempts, or unsolicited communications.
• Reverse engineer, scrape, or attempt to access non-public APIs or other users' data.
• Bypass rate limits, abuse the AI features, or otherwise impose unreasonable load on the Service.
• Upload content that is illegal, defamatory, hateful, harassing, sexually explicit, or that infringes anyone's rights.
• Use the Service in violation of any applicable law (including export control, sanctions, and data-protection laws).

We may suspend or terminate accounts that violate these rules, immediately and without notice if necessary to protect the Service or other users.

5. AI features

Showcify uses third-party large language models (currently Anthropic's Claude API) to power resume parsing, ATS scoring, and content suggestions. AI output is generated automatically and may be inaccurate, incomplete, or out of date. You are responsible for reviewing any AI-generated content before relying on it or publishing it.

We do not guarantee that AI-generated suggestions will improve your job search outcomes, get you past any specific applicant tracking system, or produce factually correct text. Use AI features as a starting point, not as a substitute for your own judgment.

6. Plans, payments, and cancellation

6.1 Free and paid plans

Showcify offers a free plan and several paid tiers (Lite, Pro, Max). The features and limits of each plan are described on our Pricing page. We may change plan features or pricing for new subscriptions; if we change pricing for an existing subscription, we will notify you in advance.

6.2 Billing

Paid plans bill in advance, monthly or annually depending on the option you choose, through our payment processor Razorpay. By subscribing, you authorise us to charge your payment method for each billing period until you cancel.

6.3 Cancellation

You can cancel any time from your account billing settings. Cancellation takes effect at the end of the then-current billing period — you keep access to paid features until then. We don't pro-rate refunds for partial periods.

6.4 Refunds

Unless required by applicable law, all fees are non-refundable. We may issue refunds at our discretion in clear cases of billing error or extended Service unavailability — write to support@showcify.com with the details.

6.5 Failed payments

If a renewal payment fails, we'll attempt to retry over several days. If payment continues to fail, we'll suspend access to paid features and may move your account to the Free plan. Your portfolio content stays intact.

6.6 Taxes

Listed prices are exclusive of any applicable taxes (e.g. GST in India). Razorpay collects taxes where required and shows them at checkout.

7. Published portfolios

When you mark a portfolio as “published”, it becomes accessible to anyone with the link and may be indexed by search engines. We don't actively police published portfolios, but we may remove content that violates these Terms or applicable law.

You can unpublish a portfolio at any time from your dashboard. Cached copies in third-party search engines are outside our control.

8. Intellectual property in the Service

The Showcify name, logo, website, app, source code, design, and all related materials (other than Your Content) are the intellectual property of Showcify Inc. or its licensors. Nothing in these Terms transfers any of that intellectual property to you.

9. Suspension and termination

You can close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, if your account is used for illegal activity, or if continued service would expose us or other users to material risk. Where reasonable and lawful, we'll give notice and an opportunity to remedy the issue first.

On termination, your right to use the Service ends immediately. We will retain or delete your data per our Privacy Policy.

10. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI-generated output will meet your needs.

11. Limitation of liability

To the maximum extent permitted by law, Showcify and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability to you for all claims arising out of or related to the Service in any 12-month period will not exceed the greater of (a) the fees you paid to Showcify in that 12-month period, or (b) USD 100.

Some jurisdictions don't allow these limitations — in that case, the limitations apply to the maximum extent permitted by your local law.

12. Indemnity

You agree to indemnify and hold Showcify harmless from any claim, loss, or damage (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Service, or (c) your breach of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. For material changes, we'll notify you by email and / or prominent notice in the app at least 30 days before the change takes effect. Continuing to use the Service after a change means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Lucknow, India.

Where you have non-waivable consumer rights under the law of your country of residence, nothing in these Terms removes those rights.

15. Miscellaneous

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Showcify regarding the Service.
• No waiver. Our failure to enforce a right or provision of these Terms is not a waiver of that right.
• Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
